All bat species are protected by law (including endangered species).

It is illegal to kill bats except in very limited circumstances (e.g., confirmed or suspected rabies exposure).

Only one legal removal method: EXCLUSION

The only permitted method is humane exclusion (one-way devices that let bats leave but not re-enter).

Illegal methods include:

  • Poison, fumigants, or chemicals
  • Glue traps
  • Killing or trapping bats
  • Sealing entry holes while bats are still inside

Strict seasonal restrictions (VERY important)

Prohibited / Restricted periods:

  • May 16 – July 31 (maternity season)
    • Restriction applies when 5+ bats are present
    • Protects flightless baby bats
  • October 15 – March 31 (hibernation season)

👉 During these periods, you cannot perform exclusion without special written permission from ODNR. BUT WE CAN INSPECT ANYTIME. Night time inspections may be required.

Allowed exclusion windows

The typical legal working windows are:

  • April 1 – May 15
  • August 1 – October 15

These are the safest times biologically and legally.

Exceptions (permit required)

You may be allowed to work during restricted periods only if you obtain written authorization, typically for:

  • Human health or safety risks
  • Rabies exposure concerns
  • Favorable weather (winter exception: temps above ~40°F forecast)

Special rules for structures

  • Interior sealing (living space access) can be done anytime without a permit
  • Exterior exclusion requires proper devices first (you cannot just seal holes)

    • Stay in place at least ~1 week
    • Be removed and holes sealed immediately after bats are gone
